Falls fallout: Edmond development headed to sheriff's sale

Nearly $5 million worth of real estate from the failed Falls condominium and shopping center development is slated to be auctioned off at sheriff's sales in the coming weeks after one of the developers pleaded guilty to money laundering in federal court.

Between 2006 and 2008, Swann bilked investors out of about $5 million to invest in The Falls, according to court documents. He promised returns as high as 20 percent, as well as an ownership interest in the development once it was built, but instead used the money to pay off early investors and to help fund a lavish lifestyle, according to court records.Swann pleaded guilty in February to one count of money laundering in U.S. District Court in Oklahoma City as part of a plea agreement with federal prosecutors. He faces a maximum 10 years in prison and a $250,000 fine, or twice the amount of any ill-gotten gains involved in the case."There are number of second mortgages out there, as well as liens on the properties," he said. Many investors in The Falls development have yet to be repaid and have some claims to the land, according to court documents. The land fell into foreclosure after developer Derek C. Swann used money from investors in the project to pay for memberships to tony Gaillardia Country Club for him and his business partners, as well as to lease several BMWs, according to court records.A building that once belonged to the Oklahoma Municipal Power Authority at 2300 E. Second St., appraised at $1.9 million, is headed for a sheriff's auction Thursday at the Oklahoma County courthouse. More than 22 acres of land, valued at $2.9 million, involved in the case are headed for the auction block on April 7.Swann is free on $10,000 bond while awaiting sentencing, according to court documents. His attorney, David Ogle, could not immediately be reached for comment on Monday. In court documents, VanHoose wrote that he decided to accept a plea agreement to "(accept responsibility for) my conduct" and because of a "desire to avoid potentially more serious and/or more numerous criminal charges."He faces up to five years in prison and $250,000 fine and is free on $5,000 bond while awaiting sentencing."There are a number of people out there and entities who apparently loaned The Falls money or the principals owed them some money," said Ray Zschiesche, an attorney who is representing lender Allegiance Credit Union in one of the foreclosure lawsuits against The Falls developers.Swann filed for Chapter 7 bankruptcy in 2009, reporting $16.3 million in liabilities, against $7.5 million in assets. Most of Swann's assets were in real estate pegged for The Falls development, outside of a 2007 BMW and a $1,200 set of golf clubs, according to U.S. Bankruptcy Court records. One of Swann's business partners, Mark A. VanHoose, pleaded guilty in January to one federal charge of conspiracy to make a false statement to a bank. VanHoose conspired with his business partners to created false financial statements that inflated his net worth to persuade Citizens Bank of Edmond to loan him $50,000, according to court documents. Some of land was cleared and graded several years ago, but construction never began on the $40 million Falls development near E. Second Street and Vista Lane in east Edmond. The project was supposed to include 130,000 square feet of office and retail space and 194 condominiums with amenities like granite countertops, gas fireplaces, wet bars and 42-inch plasma TVs.

In court documents, VanHoose wrote that he decided to accept a plea agreement to "(accept responsibility for) my conduct" and because of a "desire to avoid potentially more serious and/or more numerous criminal charges."

Gas Fireplaces: Adding Warmth To Your Home

No matter where you live, in a townhouse, a lakeside cottage, an urban loft, or a vintage Victorian mansion, there is always a place for a gas fireplace. Convenient and easy to use, gas fireplaces today offer an abundance of design ideas to suit both your lifestyle and the style of your home.

The firebox of the gas fireplace is lined with a refractory material that looks like bricks or stones. Instead of blue unappealing flame that most of us expect from the gas, the fireplaces emit completely natural-looking flames that spout from invisible holes in prefabricated ceramic logs. Often these logs form a realistic pile on the bottom of the firebox. Some people prefer the inserts that look like a coal in Victorian-styled fireplaces.Gas fireplaces are very energy efficient and can even be used to heat a whole house. With a prefabricated duct system heat travels from one room to another, however, not many households allow for this unless installed during construction. Gas fireplaces, being very easy to use, can be even turned on with a remote control or by the Internet in the new smart home! Thermostats allow for an easy heat adjustment, and with many programmable features you can also change the flame length and intensity.Gas fireplaces are becoming a more and more popular alternative to conventional built-in fireplaces. Gas fireplaces can be as individual as you are. They can be framed in wood, finished in stucco, stone, or tile, thus fitting into most landscapes and home design solutions. Gas fireplace can become a focal point of your backyard or patio, and as any room in your home, an outdoor space must bear the same design concept as indoors. That is why when choosing a fireplace you should think about the environment in which it will be placed and how it will fit with the existing decor. But no matter which technology or functionality you choose, it is largely a design and materials that give your new appliance its distinctive style and make a design statement.Gas fireplaces are fuelled by propane or natural gas. Propane can be stored in a reservoir on your property, however, it can be more expensive in the rural areas compared to the wood. But with this type of fireplaces, you dont need a lot of logs to chop and store. In general, gas fireplaces require significantly less maintenance.Modern fireplaces offer a variety of choices when in comes to fuelling. They may be wood burning, gas- or propane-fuelled, as well as liquid fuelled. The choice is totally up to you. Do you plan to chop wood, or you opt for a convenience of a gas? The kind of fuel you choose is a crucial factor in deciding what kind of fireplace to buy. Consider availability and cost, heat efficiency and your local air pollution standards. There are special regulations that concern the design, verification and labeling of gas fireplaces or imported into the North America.

Gas, Electric, Woodburning or Vent-free Fireplace? Which Is Best?

A fireplace, to some, is simply known as an appliance that allows flammables to safely burn inside the house. In colder places like Europe and some parts of the US, tradition makes the fireplace or hearth an essential feature to keep a house warm and cozy. It is especially needed during longer periods of winter.

To know which kind of fireplace best suits your taste and budget, here is a rundown of the various types of fireplace.2. Direct Vent FireplaceThis is one user-friendly and energy-efficient sort of fireplace. Not having to gather logs and not having to clean ashes are the great conveniences this kind of hearth offers. With the help of a gas burner and a simulated log, the perfect by-the-fireplace mood is achieved without having to undergo so much fuss. Propane or natural gas is the fuel used on gas fireplaces.Indoors and outdoors, a direct vent fireplace can be easily installed. Yes, this hearth is that versatile. New homeowners can benefit a lot from this type of fireplace because of this attribute and its availability in various designs and shapes. This hearth does not affect the quality of the indoor air and thus considered as a very efficient choice of fireplace. It doesnt require a chimney. A hole in the wall will do it for a direct vent fireplace. Tightly-sealed homes dont have to worry about the problem of having to put up with negative air pressure with this hearths state of the art mechanisms. This fireplace is good for those with a tight budget. No chimney is required for this type of hearth and it can be installed just about anywhere. More temperate countries can take advantage of this electric hearth since the heat can be easily regulated. The more modern designs of this type of fireplace are made of brick, rustic stone, wood and marble. Though, oftentimes, it is aesthetics that is given major consideration on opting for an electric fireplace, some say that its the fumeless heater that they are raving about. This type is the most famous and most favorite amongst all the fireplaces. The cozy smell of burning wood and the refreshing sound of fire are this kinds features that are considered very agreeable for many fireplace aficionados. Choice of woods must not be overlooked in maximizing this fireplace. It is advised that the chimney and the fireplace are cleaned regularly to ensure safety.5. Wood Burning FireplaceWith the perfect kind of fireplace, countless possibilities can happen.Aside from the built of those abovementioned fireplaces, the material with which they are made of must also be given major attention. This is not only to guarantee the visual appeal that your choice of fireplace will add to your home but also its durability and efficiency.1. Electric fireplace3. Gas FireplaceAlso known as ODS (Oxygen Depletion Sensor), this kind of fireplace deals with the dilemma damper that has to stay open as with a direct vent fireplace. To live its moniker, the gas is plainly linked to the hearth to make the flame burn without a vent. This type of fireplace has gas that burns more cleanly and cost-effectively than those with gas and electricity.

With the perfect kind of fireplace, countless possibilities can happen.

Advantages to a Gas Fireplace

In the past, gas fireplaces were mostly freestanding units that took up potentially valuable living space in your home. They also had only flickering blue flames for ambiance a far cry from the dancing of yellow and orange flames in a wood burning fireplace.

Gas fireplaces are also a benefit in areas where burn bans are in effect in order to reduce the amount of smoke in the environment. Even during an elevated burn ban, you can still run a gas fireplace when you can't have a wood burning fire or sometimes even a fire in a pellet stove.Wood for a traditional stove has to be purchased (or cut down), chopped to size, stacked lugged inside during snowy winters, and then you have to clean up. Also, woodpiles are invitations for all sorts of critters, some dangerous. You can also get models with pretty realistic looking logs and burning embers. However the logs in gas fireplaces are made of ceramic or concrete. You can even get remote control to change the flames to your liking!Gas fireplaces are typically cleaner than traditional wood burning fireplaces. There is no wood to lug in, so you won't have bark and wood chips all over the hearth and floor. There is also no ash to scoop out and dispose of regularly. There is also no threat of burning logs tumbling off the grate or sparking embers jumping out onto your floor.Today's models are improving year by year. You can get a freestanding model or a fireplace insert model. You can choose between a vented or ventless model, depending on your needs. You can choose between natural gas and propane hookups. You can also hook a gas fireplace up so that, should electricity be out for days, you can disconnect and cap the gas line in a matter of minutes, and thus transform your fireplace back into a wood burning fireplace. This is a huge benefit if you live in an area where ice storms and other severe weather threaten power outages that can last for days in sub-zero weather. If you have young children in the house, a gas fireplace can give you great peace of mind knowing they won't throw anything into the fire or climb up on the hearth when you aren't looking for 3 seconds. With gas fireplaces, you can turn them off completely before going to bed or leaving. No more worry about putting the fire out or waiting until it burns out.But before you purchase a gas fireplace, do research and ask lots of questions about the different models and features so you make the best decision possible.

Individual traditional and contemporary fires and fireplaces to suit all tastes; ADVERTISEMENT FEATURE

IF you want to create a stunning focal point for your living space, then take a look at all the great designs now available at Fireplace Superstore in nearby Birstall.

One of the range of stoves now on display at the Birstall showroom Pictured (above) contemporary hole-in-the-wall fires and (below) the Birstall showroomA few weeks ago my daughters and I were driving back from the Springs to Woodland Park and it truly was the first time we noticed the many tents and homeless near Eighth Street and Cimmaron. A few days later we read the article Barry Noreen wrote in The Gazette on the homeless. We knew as a family we could help in some way. Last Sunday we made up lunches, gathered up a sleeping bag, scarves, sweatshirts, hats, gloves and drove down there. We walked down the embankment when a woman by the name of Maggie, who lives there, met us and took us along the creek to distribute the items. She knew everyone by name and the reasons why each ended up homeless. We talked and gave hugs to the people we met and told them we would be back. We have been back twice since then, bringing barrels of firewood and food. The first time we were there the fire and ambulance crew were giving aid and a lot of compassion to a man who lost all feeling in his feet and lower legs. These people are cold, hungry, and some are dying out there. They are so appreciative for whatever help we can give them. What seems so little to us is so much to them. If you are able to help in any small way, please do.CAPTION(S):With around 100 traditional and contems porary fires and fireplaces on permanent display, these great choices add style and value to your home without costing a fortune.Doctors & nurses volunteerKimberly ThorntonMel DownsI do not feel that the city should hire someone to clean up after and monitor these people, but provide a portable toilet and a place to set up their tents, maybe one security guard to make sure it is a safe environment. Whatever the cure, I hope that it is fair to all of us, the taxpayer, the city residents and business owners, and the homeless.Colorado Springs.

Jerky, firewood on the way

Walk into the showroom and you''ll first of all see a display of multi-fuel and wood burning stoves, all of which are live working examples. Enter the main display area and you''ll find fireplaces created from marble, wood, limestone, stone effect and much more.Primary concerns to me are: 1. Creek contamination from human waste, trash, and other chemicals. 2. Trash (visual, rodent attraction, disease spreading). 3. Clean water availability. 4. Burning firewood. Whenever I think about camping, that's the setting I think of. The campsites along the Front Range Trail are addressed here. Maybe we've gone a little overboard on providing all the open space and other amenities for the "elite" people in our community at the peril of the down-trodden. Surely we can do better. Where are all those "Christians" I keep hearing about, and their helping others mentality? As a 67-year-old, recently retired hospice nurse with 19-plus years with Pikes Peak Hospice, I needed to find another practice with "heart and soul" to volunteer with in order to feel that I had a meaningful link with my community. I was thrilled to discover the S.E.T. clinical opportunities available to those of us who have active licenses and want to remain connected. The "Homeless Clinic" sponsored by S.E.T. at the Soup Kitchen/Marian House on Bijou is staffed by volunteer physicians and nurses who volunteer at the clinic. We process as many as 15 or as few as eight, depending on the day, providing them with expert medical care (the doctors are often coming from the emergency rooms at the local hospitals or are, like me, recently retired). We also provide medication and some simple treatments at times to stabilize a condition. We also refer them to other clinics (Peak Vista Mission, Medical and others) if they need a more complete work-up.Woodland ParkSeveral years ago our church was doing some outreach to the homeless, and one of the items that was very popular and appreciated by them was jerky. My husband does a lot of hunting, and we have plenty of venison, some of which we make into jerky. It is very practical for the homeless since it doesn't spoil easily, is lightweight, and can provide a much-needed source of protein. Since my daughters and husband have all gotten elk this year, we plan to make an extra large batch of jerky soon and share it with the homeless. Additionally, we, like many other households, have a gas fireplace, and don't really need the firewood that is stacked by our house. We plan to take our extra firewood to a "tent city" and distribute it, or contact the Colorado Springs Police Department or Springs Rescue Mission to get ideas for how to distribute both the jerky and the firewood.I would be willing to volunteer time and donate money toward helping out.

At the compound entrance could be a food, clothing shelter drop to provide the residents with their daily needs. The donation site could be managed by one of the non-profit organizations. By all means, there should be bulletin boards or a clearing center to help them enter programs to move out of the compound. There could be pick up sites for day workers, or for those looking to go to another part of the city.

Best Practices Can Prevent Carbon Monoxide Poisoning

Fuel-burning space heaters and portable generators used during cold weather months can release harmful carbon monoxide (CO) gas. CDC reports that CO poisoning sends more than 20,000 people to emergency rooms and claims nearly 400 lives each year. ADT Security Services offers several tips to prevent CO poisoning in homes:

This problem is not going away. Instead of trying to sweep it under the carpet, how about creating a formal shantytown. Suppose the city were to put a fence around a piece of property, like the block bordered by West Cimmaron and South Sierra Madre. Inside the fenced area would be a grid system that allows the homeless to erect their structures in an orderly fashion. Internal to the complex can be portable restrooms and running water - even portable showers are possible. This site is chosen because of it's proximity to Wal- Mart, Marian Soup Kitchen, Red Cross, the walk along the creek, and its distance from other residences.Just two paychecks awayI propose a designated area for homeless camps. I noticed a beautiful site on the north side of the trail and east of South Nevada that would be wonderful. It looked to me like an old trailer park. It wouldn't take much to clean it up and lay out specific campsites. It would require rules for usage and violation of the rules would result in eviction. If living along the creek continues to be allowed, rules should apply as well. Solutions, by the numbers: 1. Porta Potties should be stationed at reasonable intervals; 2. Trash Dumpsters should be placed at convenient locations; 3. Install spring-loaded (can't be left on) water faucets; 4. Provide firewood (good supply from city foresting operations); 5. The only solution here is to move the camps to a location away from the creek or build isolation fences (similar to the sound barriers along I-25.Thanks for taking our input.

*Install at least one carbon monoxide detector on every level of your home and near sleeping areas.
